In regards to strict liability or negligence?

There was a recall for a child's water can that was shaped like a duck. Now the recall states that the beak was painted with paint that contained lead, which is a direct violation that prohibits using paint that contains lead and using it on a child's toy. Now my question is would you sue for negligence or would you sue for strict liability. And if the other side could defend themselves, what could they do to defend themselves.
